Illinois Medigap Birthday Rule: Who Can Switch and When
Illinois provides a 45-day annual period beginning on the birthday of certain Medigap policyholders ages 65 through 75, with important issuer, affiliate and benefit limits.

Quick answer: An Illinois resident who is at least 65 but no more than 75 and has an existing Medigap policy is entitled to an annual 45-day open-enrollment period beginning on their birthday. The protected choice may be a Medigap policy from the same issuer or from an affiliate authorized to transact business in Illinois, as long as the new policy offers benefits equal to or less than the current coverage.
How Does the Illinois Birthday Rule Work?
The Illinois protection creates an additional annual opportunity beyond the one-time federal Medigap Open Enrollment Period. Its 45-day clock begins on the policyholder’s birthday.
Age
You must be at least 65 and no more than 75. Age 75 is included in the rule’s wording.
Timing
The annual period lasts 45 days and commences with your birthday.
Existing coverage
You must already have a Medicare Supplement policy.
This is not the October 15–December 7 Annual Enrollment Period, and it is not based on the current policy’s anniversary date.
Which New Policy Is Protected?
The Illinois rule protects the purchase of a Medigap policy from the same issuer or from an affiliate authorized to transact business in Illinois when the new policy offers benefits equal to or lesser than the current policy. It is not a general right to move to any unrelated carrier without underwriting.

When Does the 45-Day Window Begin?
Day one is the birthday. The period then continues for 45 days. It does not begin before the birthday under the rule described by the Illinois Department of Insurance.
Because carriers may need time to process the request, start comparing available same-issuer and qualifying affiliated options before the birthday, but submit the protected election in the permitted period and follow the insurer’s instructions.
Confirm the final calendar date for your year with the insurer. Do not rely on an approximate month-and-a-half estimate when a specific deadline controls eligibility.
What Should You Compare?
- The exact standardized benefits in the current and proposed policies
- The new monthly premium and effective date
- Whether household or payment discounts change
- The pricing method and future age treatment
- Any difference between standard Medigap and Medicare SELECT
- Whether moving to lesser benefits could be difficult to reverse later
A lower-benefit plan can reduce the premium but increase cost sharing. Future attempts to regain richer benefits may require underwriting unless another protected right applies.

- Confirm your age and birthday-window dates.
- Confirm eligible equal-or-lesser-benefit choices with the current issuer and, when applicable, an affiliate authorized to transact business in Illinois.
- Compare premiums, benefits, rating method and discounts.
- Submit the application or change request within the 45-day period.
- Confirm approval and the replacement effective date before ending the old policy.
Do not let the current policy lapse while the change is pending. Keep written confirmation of the protected period, selected policy and effective date.
