Medigap is private insurance. Federal law creates strong buying protections at particular times, but it does not require every carrier to accept every application at all times.

There is no single universal list used by every Medigap company. Insurers may focus on serious or unstable conditions, recent hospitalization, pending surgery, active cancer treatment, certain cardiac or pulmonary conditions, kidney disease, use of particular medications or other indicators defined in their current guidelines.

A diagnosis alone does not always determine the result. Timing, severity, stability, treatment history and the carrier’s questions can matter. This is why a general statement such as “everyone with diabetes is denied” or “a past heart condition is always accepted” is unreliable.

An informal pre-screen can help identify likely carrier differences, but it is not an approval. Only the insurance company can make the final underwriting decision.

When Health Cannot Be Used to Deny the Policy

During the federal Medigap Open Enrollment Period, an insurer cannot use medical underwriting to refuse one of the Medigap policies it offers. A qualifying guaranteed-issue right also requires an insurer to sell specified Medigap policies and prevents health-based pricing for those protected choices.

Guaranteed-issue rights are event-specific. Common federal situations involve certain losses of coverage, certain Medicare Advantage terminations, and limited trial rights. The exact policy letters and application deadlines vary by event.

An election period is not the same as a Medigap right. Permission to leave or change a Medicare Advantage plan does not by itself require a Medigap insurer to accept the application.

How to Apply Without Creating a Coverage Gap

  1. Identify your enrollment status. Determine whether open enrollment, guaranteed issue or a state rule applies.
  2. Keep proof. Save termination notices, plan letters, envelopes and prior-coverage records.
  3. Apply accurately. Complete all required questions and provide the protected-right documentation when applicable.
  4. Wait for a decision. An application submission is not the same as approval.
  5. Coordinate dates. Confirm the new policy’s effective date before ending existing coverage.
